Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://evotega.com/ (the "Site"), operated by Evotega ("Evotega," "we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, available at [LINK TO PRIVACY POLICY], which is incorporated here by reference. If you do not agree, please discontinue use of the Site.

PLEASE READ SECTION 22 CAREFULLY. IT CONTAINS AN ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES BETWEEN YOU AND EVOTEGA ARE RESOLVED.

1. Eligibility

The Site is intended for use by adults age 18 and older. By using the Site or submitting information through it, you represent that you are at least 18 years old and that you have the legal authority to provide any information you submit, including information about a child for whom you are the parent or legal guardian.

2. Acceptable Use of the Site

The Site is provided for informational purposes and to help individuals and families learn about our ABA therapy services. By using the Site, you agree to:

  • Use the Site in a lawful manner

  • Provide accurate and truthful information when submitting forms or inquiries

  • Refrain from interfering with the operation or security of the Site

  • Refrain from using the Site for fraudulent, harmful, or unauthorized purposes

  • Refrain from scraping, data mining, or using automated means to access the Site without our written permission

  • Refrain from attempting to access accounts, systems, or data not intended for you

3. No Medical Advice and No Provider Relationship

The information on the Site is provided for general informational purposes only. It is not medical, psychological, behavioral, legal, or other professional advice, and it should not be relied on as a substitute for consultation with a qualified professional.

Visiting the Site, submitting a form, or communicating with us through the Site does not create a provider-client relationship. Clinical recommendations and treatment decisions are made only after a formal consultation, intake, and assessment.

If you are experiencing a medical or behavioral emergency, call 911 or go to the nearest emergency room. Do not use the Site to communicate urgent or emergency needs.

4. Not a Secure Channel

The Site is not a secure channel for health information. Do not submit diagnoses, evaluation results, medical records, treatment history, or insurance member numbers through Site forms, chat, or email. See our Privacy Policy for details on how we handle health information and on our Notice of Privacy Practices.

5. Service Availability and Eligibility

Our services are subject to availability, geographic service area, insurance and funding requirements, eligibility criteria, and clinical assessment. Submitting an inquiry or consultation request does not guarantee eligibility for services or acceptance as a client.

We reserve the right to decline or discontinue services consistent with applicable law and professional ethical obligations.

6. Professional Credentials and Scope of Practice

Applied Behavior Analysis services described on the Site are designed and supervised by professionals credentialed by the Behavior Analyst Certification Board and licensed as required by [STATE] law. Individual results vary. Outcomes depend on many factors, including the individual client, the intensity and duration of services, family participation, and other circumstances. No specific outcome is promised or guaranteed.

7. Testimonials, Reviews, and Public Statements

Any testimonial appearing on the Site is used in accordance with the Ethics Code for Behavior Analysts and applicable privacy law. We do not solicit testimonials from current clients or their family members for advertising purposes. Testimonials from former clients or family members are published only with informed written consent, which may be withdrawn at any time, and are identified as solicited or unsolicited along with an accurate description of the author's relationship to Evotega.

We do not control unsolicited reviews posted on third-party platforms. If you believe a testimonial or review on the Site should be removed, contact us using the details in Section 27.

8. Billing Transparency and Good Faith Estimates

You have the right to receive a Good Faith Estimate explaining how much your care will cost if you are uninsured or if you choose not to submit a claim to your health plan. Under federal law, health care providers must give patients who do not have insurance or who are not using insurance an estimate of the expected charges for services.

You have the right to receive a Good Faith Estimate in writing at least one business day before your service. You may also ask for a Good Faith Estimate before you schedule. If you receive a bill that is at least $400 more than your Good Faith Estimate, you can dispute the bill.

For questions or more information about your right to a Good Faith Estimate, visit cms.gov/nosurprises or call [PHONE NUMBER]. Make sure to save a copy or picture of your Good Faith Estimate.

9. Nondiscrimination

Evotega complies with applicable federal and state civil rights laws and does not discriminate on the basis of race, color, national origin, age, disability, or sex. We provide free aids and services to people with disabilities to communicate effectively with us, and free language assistance services to people whose primary language is not English.

10. Accessibility

We are working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter an accessibility barrier on the Site, or need information from the Site in an alternative format, contact us using the details in Section 27 and we will work with you to provide the information you need.

11. Intellectual Property

All content on the Site, including text, graphics, logos, images, video, designs, and software, is the property of Evotega or its content providers and is protected by United States and international intellectual property laws.

You may view and use the content for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, publish, frame, or create derivative works from the content without our prior written permission.

If you believe content on the Site infringes your copyright, send a notice containing the elements required by the Digital Millennium Copyright Act to our designated agent at [DMCA AGENT NAME, EMAIL, AND ADDRESS].

12. User Submissions

When you submit information through forms, messages, or other communication methods on the Site, you represent that:

  • The information you provide is accurate and truthful

  • You have the right to provide the information submitted

The Site may link to third-party websites, social media platforms, or external resources for your convenience. We do not control and are not responsible for the content, policies, practices, or availability of any third-party site. Accessing such sites is at your own discretion and risk.

14. Electronic Communications

By providing your email address or phone number, you consent to receive communications from us electronically regarding your inquiry and our services. You may withdraw consent to marketing communications at any time by using the unsubscribe link in any marketing email, replying STOP to any text message, or contacting us using the details in Section 27. Withdrawing consent to marketing does not affect service-related communications relating to care you are receiving.

15. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, EVOTEGA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND MAKES NO WARRANTY REGARDING:

  • THE ACCURACY OR COMPLETENESS OF SITE CONTENT

  • THE AVAILABILITY OR UNINTERRUPTED OPERATION OF THE SITE

  • THE ABSENCE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS

YOUR USE OF THE SITE IS AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Nothing in this section limits any warranty, representation, or obligation relating to clinical services provided under a separate services agreement.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVOTEGA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • Your use of or inability to use the Site

  • Reliance on information provided through the Site

  • Technical issues, interruptions, or Site errors

  • Unauthorized access to information transmitted through the Site

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED [ONE HUNDRED DOLLARS ($100)].

These limitations do not apply to liability arising from clinical services, professional negligence, gross negligence, willful misconduct, or any liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless Evotega and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right. This provision does not apply to claims arising from clinical services.

18. Modifications to the Site

We may modify, suspend, restrict, or discontinue any portion of the Site at any time without prior notice. We may also update Site content and service descriptions as needed.

19. Changes to These Terms

We may revise these Terms from time to time. Updated versions will be posted on this page with a revised Effective Date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. If a change materially affects your rights, we will provide additional notice where required by law.

20. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections 11 through 17 and Sections 21 through 26 survive termination.

21. Governing Law and Venue

These Terms are governed by the laws of the State of [STATE], without regard to its conflict of law principles. Arbitration. If informal resolution is unsuccessful, any dispute arising from or relating to these Terms or your use of the Site shall be resolved by binding individual arbitration administered by [ARBITRATION PROVIDER] under its then-current rules, rather than in court, except that either party may bring an individual action in small claims court.

Class action waiver. You and Evotega agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Exclusions. This Section does not apply to claims arising from clinical services or professional negligence, or to any claim that cannot be arbitrated under applicable law.

Opt out. You may opt out of this arbitration agreement by sending written notice to [ADDRESS] within 30 days of first accepting these Terms.

23. Severability

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will remain in full force and effect.

24. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.

25. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

26. Entire Agreement and Force Majeure

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Evotega regarding the Site and supersede any prior agreements regarding the Site. Any services you receive from Evotega are governed by a separate services agreement, which controls over these Terms with respect to those services.

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control.
